Terms of Use

Global Governance Master Terms. These Terms of Use govern access to the GoTecID website, portals, APIs, and client platforms. Additional Service Level Agreements (SLAs) apply to Enterprise (GORG) Accounts.

Welcome to GoTecID™. These Terms of Use (“Terms”) form a binding legal agreement between you (“User”, “you”) and GoTecID (Pty) Ltd (“Company”, “we”, “us”). By accessing our website, platform portal, or services, you agree to comply with and be bound by these Terms.

1. Platform Scope & Operating Model

GoTecID provides a zero-trust, consent-driven document vault and tracked transmission platform:

  • Custodial Envelope Role: GoTecID operates as a secure document custodian. We encrypt and deliver files according to user instructions. We do not verify, validate, edit, or authenticate document contents or independently confirm the identity of callers beyond multi-factor authentication credentials. Receiving organizations remain solely responsible for performing statutory due diligence (e.g., FICA/AML/KYC checks).
  • Consent Architecture: Documents uploaded to your vault are never shared without explicit, revocable access permissions defined by the vault owner.

2. Acceptable Use & User Conduct

You agree to use the website and platform strictly for lawful purposes. You must not:

  • Upload, store, or transmit fraudulent, illegal, defamatory, or malicious content, or files containing active virus payloads.
  • Attempt to bypass security features, reverse engineer, probe, or vulnerability-scan the GoTecID platform infrastructure.
  • Impersonate any individual, corporate entity, or governmental organization.
  • Use automated bots, scrapers, or mass data extractors to harvest platform data.

3. User Account Responsibilities

When registering an account or accessing the GoTecID portal:

  • Account Security: You are responsible for maintaining the confidentiality of your access credentials and multi-factor authentication (MFA) devices. You must notify us immediately at rventer@fintecgroup.co.za if you suspect compromised credentials.
  • Accuracy of Details: You represent that information provided during account creation is accurate, current, and complete.

4. Intellectual Property Rights

The GoTecID name, logos, platform code, interface designs, trade dress, and service concepts are protected under South African and international copyright, trademark, and intellectual property laws:

  • Trademarks: “GoTecID”, the GoTecID mark, and associated brand icons are trademarks of GoTecID (Pty) Ltd (CIPC application pending).
  • User Content Ownership: You retain full ownership and intellectual property rights over all files and documents you upload to your private vault. By uploading files, you grant GoTecID a limited, non-exclusive license solely to host, encrypt, and render view-only streams as instructed by your share settings.

5. Third-Party Links & Integrations

Our website or services may contain links to third-party web portals, external compliance services, or regulatory databases (such as the South African Information Regulator). GoTecID does not endorse, control, or assume liability for third-party content, policies, or practices.

6. Warranty Disclaimer

To the maximum extent permitted by applicable law, the GoTecID website, portal, and service features are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of Liability

To the maximum extent permitted under applicable law (including South African Consumer Protection legislation, EU Digital Services Act, and US State Commercial Codes):

  • GoTecID (Pty) Ltd, its directors, employees, and affiliates shall not be liable for any indirect, incidental, punitive, or consequential damages, or loss of profits, revenue, or data arising out of or in connection with your use of the platform.
  • In no event shall our total aggregate liability exceed the total amount paid by you to GoTecID in the six (6) months prior to the claim, or ZAR 1,000 (whichever is greater).

8. International & Regional Compliance Framework

GoTecID operates in compliance with international privacy laws, including POPIA (South Africa), GDPR (EU/UK), and CCPA/CPRA (USA):

  • Cross-Border Users: Accessing GoTecID from outside South Africa indicates your agreement that personal data processing will adhere to our Global Privacy Policy.
  • Enterprise Compliance: Business accounts processing data on behalf of global data subjects must execute our standard Data Processing Agreement (DPA) incorporating Standard Contractual Clauses.

9. Dispute Resolution & Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without giving effect to conflict-of-law principles:

  • Informal Negotiation: Parties agree to attempt informal resolution of any dispute for at least 30 days before initiating formal legal proceedings.
  • Jurisdiction: Any legal dispute arising under these Terms shall fall under the non-exclusive jurisdiction of the High Court of South Africa (Western Cape Division, Cape Town). International users retain applicable statutory consumer forum protections where mandatory by local law.

10. Modifications & Severability

We reserve the right to update these Terms at any time. Changes will be posted to this page with an updated timestamp. If any provision of these Terms is found invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
